Terms of Service

1. Acceptance

By creating an account or using the Waqly platform, you agree to these Terms of Service. If you are using Waqly on behalf of a business, you represent that you have authority to bind that business to these terms.

2. Use of the platform

You may use Waqly only for lawful business communication purposes and in compliance with: • Meta's WhatsApp Business Platform Terms of Service • WhatsApp's Business Policy • All applicable laws in your jurisdiction You are responsible for obtaining proper opt-ins from contacts before messaging them via WhatsApp.

3. Account responsibilities

You are responsible for keeping your login credentials and WhatsApp API credentials secure. You must notify us immediately at hello@waqly.com if you believe your account has been compromised.

4. Subscriptions and billing

Plans are billed monthly or annually in advance. You may cancel at any time; your access continues until the end of the paid period. We reserve the right to change pricing with 30 days notice. You will be notified by email before any price change takes effect. Refunds are not provided for partial billing periods, except where required by law.

5. API and AI usage

Waqly provides access to Meta's WhatsApp Cloud API and third-party AI providers. You are responsible for your own API keys, usage costs and compliance with each provider's terms. Waqly is not liable for costs incurred through your AI provider usage.

6. Prohibited uses

You may not use Waqly to: • Send spam or unsolicited messages • Violate WhatsApp's commerce or business policies • Distribute malware or phishing content • Scrape or harvest contact data without consent • Impersonate another person or business

7. Data and privacy

Your use of personal data obtained through Waqly is governed by our Privacy Policy and applicable data protection laws. You are the data controller for your customers' data.

8. Termination

We may suspend or terminate your account if you violate these terms or WhatsApp's policies, with immediate effect and without refund. You may terminate your account at any time by contacting hello@waqly.com.

9. Limitation of liability

Waqly is provided "as is". To the maximum extent permitted by law, Waqly is not liable for indirect, incidental or consequential damages. Our total liability shall not exceed the amount you paid in the 3 months preceding the claim.
